The Supreme Court ruled that intermediaries like Google can't claim any protection for publishing defamatory content online before the 2009 amendment to Section 79 of the IT Act. A bench led by justice KM Joseph rejected the contention of Google and has asked Google to face trial. The apex court has also set aside the findings by the HC regarding the alleged refusal of the appellant to respond to the notice to remove content.
